Military Court

DFWA and ADSO have some significant concerns in relation to the Military Court of Australia Bill 2010 (“the Bill”). The Bill, when enacted, will establish the Military Court of Australia to try serious service offences alleged against members of the Australian Defence Force, in place of the present system of trial by court martial and Defence Force Magistrate.
 

While legislation to provide for the Court to be established has been delayed, we continue to strongly oppose the provisions of the Bill which would provide for the trial of serious service offences in the MCA by judge or federal magistrate alone, rather than, in effect, a jury of peers. We maintain that this is at the very least against the spirit of the Australian Constitution.
